2. Petitioner seeks bail who is in custody since 22.01.2023 in connection with S. Tr. No. 423 of 2023 arising out of Mokama P.S. Case No. 368 of 2022, F.I.R. dated 25.11.2022 for the offences punishable under Sections 448, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier the bail application of the petitioner has been rejected by this Hon'ble Court vide order dated 11.08.2023 passed in Cr. Misc. No. 40166 of 2023.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case.

5. Vide order dated 23.02.2024 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 04.03.2024 reveals that all the seven witnesses have already examined and the case is pending for the argument.

6. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner on the ground that the petitioner carries three criminal antecedents other than the present one.

7. Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with S. Tr. No. 423 of 2023 arising out of Mokama P.S. Case No. 368 of 2022 pending in the court of learned Additional District Judge IV, Barh, Patna.

8. Prayer is refused.

9. However, learned Trial Court is directed to expedite and conclude the trial at the earliest.
