Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Gopalganj (Town) P.S. Case No. 816 of 2022 dated 05.10.2022 lodged under Sections 304(B)/ 34 of the I.P.C. As per the prosecution case, the case of dowry death has been lodged against the petitioner alongwith four others who are said to be the relative of the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits that there is general and omnibus allegation present in the F.I.R.

Patna High Court CR. MISC. No. 8537 of 2023(2) dt.03-05-2023 2/2 He further submits that the husband of the deceased is already in custody which he has narrated in paragraph 8 of the petition. He further submits that the antecedent of the petitioner is clean and she is in custody since 08.10.2022. He also submits that petitioner is a lady aged about 70 years, who is mother-in-law of the deceased.

Learned counsel for the State opposes the prayer for bail and submits that it is true that age of the petitioner is 70 years and husband is already in custody and according to this Court, trial has already been commenced.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P.S. Case No. 816 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
