JUSTICE AMARESH KUMAR LAL ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner, State and the informant.

The petitioner is in custody for the offence punishable under Section 436/34 IPC.

Allegation against the petitioner is that at 8.30 P.M. the informant saw the flame of fire in the house of the informant and on the flash of torch he saw the petitioner standing there at some distance. On raising alarm, villagers came there and extinguished the fire by that time part of house and a fuel room were burnt. It has been suspected that petitioner and others have set fire in the house due to land dispute.

It is submitted that due to land dispute the petitioner has been falsely implicated in this case. He has no criminal antecedent. Other co-accused has already been granted bail by the

Patna High Court Cr.Misc. No.42828 of 2014 (3) dt.22-01-2015 2/2 lower court.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Ashish Kumar Mishra, learned Judicial Magistrate, 1st Class, Purnea/court concerned in Amour P. S. Case No. 49 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
