2. The petitioner superannuated from the post of Peon in the month of December, 2019, has approached before this Court seeking a direction upon the respondent-university to ensure payment of all his post retiral benefits as well as other dues.

3. During the pendency of the writ petition all the substantive retiral benefits and other dues have been paid to the

Patna High Court CWJC No.5530 of 2021 dt.13-08-2024 2/3 petitioner, except the arrears of salary/pension on account of 5th and 6th pay revision as well as the arrears of salary from September, 2010 to June, 2012 is the contention of the learned Advocate for the petitioner.

At this juncture, learned Advocate for the University submits that the college, in question, from where the petitioner superannuated, has come within the Patliputra University and thus the arrears of difference of salary or pension on account of revision of pay shall be considered by the Registrar, Patliputra University, and so far the arrears of salary is concerned, the petitioner may approach before the Registrar, Magadh University.

5. Be that as it may, considering the limited grievance of the petitioner, the writ petition stands disposed of with liberty to the petitioner to file a proper representation before the Registrar, Magadh University as well as the Registrar, Patliputra University, preferably within a period of four weeks from today.

6. If such a representation is filed by the petitioner, the same shall be considered and disposed of by passing reasoned and speaking order within a further period of eight weeks.

7. Suffice it to say that in case the claim of the petitioner finds favour, the necessary consequential benefits shall be paid to the petitioner within the stipulated period.
