====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-04-2019 Heard Sri Amarnath Jha, learned counsel for the petitioner and Sri Sanjay Kumar Tiwary No. 1, learned Additional Public Prosecutor.

The sole petitioner, who was made accused with name in the F.I.R., which was lodged long back on 13.02.2013 vide Bakhtiyarpur P.S. Case No. 30 of 2013 [G.R. No. 297 of 2013 ] registered for the offence under Section 467/468/471/420/120B / 34 of the Indian Penal Code, 1860, has approached this court for extending the privilege of anticipatory bail. Learned counsel for the petitioner submits that in a civil dispute colour of criminal offence has been given and as such petitioner deserves to be released on bail, however, learned Additional Public Prosecutor points out that the prayer for

Patna High Court CR. MISC. No.7662 of 2019(3) dt.04-04-2019 2/2 anticipatory bail of this petitioner was rejected by learned Sessions Judge, Saharsa on 24.04.2017 and the present anticipatory bail petition has been filed in the month of February 2019.

Considering the fact F.I.R. was lodged long back in the year 2013 naming the petitioner as one of the accused and his anticipatory bail petition was already rejected in the year 2017 by learned Sessions Judge, at this stage there is no reason to entertain the same anticipatory bail prayer. Accordingly, it is dismissed.
