Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sarsi P.S. Case No. 38 of 2020 lodged under Sections 394 of the

Patna High Court CR. MISC. No.24283 of 2023(3) dt.07-06-2023 2/3 I.P.C. read with Section 27 Arms Act.

As per the prosecution case, the F.I.R. has been lodged against unknown criminals against whom the allegation of snatching of Rs.1.5 Lac is there.

Learned counsel for the petitioner submits that nothing incriminating was recovered from the possession of the petitioner nor he was put on T.I.P.. Counsel further submits that his name has figured in this case by virtue of confessional statement of the co-accused namely, Md. Mojib. Counsel submits that the said Md. Mojib was granted bail by the Coordinate Bench of this Hon'ble Court vide order dated 23.02.2022 passed in Cr. Misc. No.37753 of 2021. Counsel further submits that there are 2 criminal cases pending against the petitioner in which he is on bail and petitioner is in custody since 07.11.2022.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Purnea in

Patna High Court CR. MISC. No.24283 of 2023(3) dt.07-06-2023 3/3 connection with Sarsi P.S. Case No. 38 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
