KUMAR ORAL ORDER 18-06-2020 The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence. Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner, apprehends his arrest registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

Allegation against petitioner is of killing the daughter of the informant and concealed her dead body due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case merely on suspicion. It has been

Patna High Court CR. MISC. No.6394 of 2020(2) dt.18-06-2020 2/2 further submitted that petitioner is the father-in-law of the deceased and he resides in separate house and he has no concern with the affairs of the husband of the deceased. Petitioner has no criminal antecedent.

In post mortem report cause of death has been stated to be asphyxia due to strangulation.

In the facts and circumstances, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected.

However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on its own merits without being prejudiced by this order. (S. Kumar, J) veena/rajiv U T
