JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Goraul P.S. Case No. 263 of 2018, registered for the offences punishable under Sections 331, 452, 323, 427, 429, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with others came and asked the informant to vacate the land, on which some altercation took place and there is specific allegation of firing on the grandson (Nati) of the informant but that did not hit anybody and thereafter accused persons damaged the property and taken away Rs.10,000/- from the informant.

Submission of learned counsel for the petitioner is that he has lodged a case against the informant and others,

Patna High Court CR. MISC. No.7704 of 2019(5) dt.02-05-2019 2/2 which will appear from Annexure-2 and there is land dispute between the parties and during investigation it is found that the case under Section 27 of the Arms Act is not true. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Goraul P.S.Case No. 263 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
