24-11-2016 Heard Sri Anshuman Singh, learned counsel, who was assisted by Sri Ramakant Yadav, learned counsel for the petitioner and learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, by order dated 01-08-2013 passed in Cr. Misc. No. 46221 of 2012, the prayer for bail of petitioner was rejected, primarily on the ground that there was recovery of about 105 Kg. of Ganja. However, while rejecting the prayer for bail, this Court had directed for disposal of the case at the earliest. In this case, earlier number of reports were summoned from the court below and lastly, a report dated 18th November, 2016 sent by learned 1st Addl. Sessions Judge, East Champaran,
Patna High Court Cr.Misc. No.47831 of 2015 (7) dt.24-11-2016 2/2 Motihari has been received, which is kept at flag 'D'. The report indicates that out of 8 charge-sheeted witnesses, 7 witnesses have already been examined and now the investigating officer as well as two seizure-list witnesses are yet to be examined, for which, appropriate processes have already been issued. In view of report of the learned court below, there is no reason to review earlier order.
The prayer for bail again stands rejected.
The Court expects that learned court below may take all steps for early disposal of the case.
Let a copy of this order be sent to the concerned Superintendent of Police for ensuring presence of the witnesses as and when required by the trial court without any delay. (Rakesh Kumar, J.) Anay U T
