JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 110 of 2019 arising out of Khajekalan P.S. Case No. 1 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case approximately 27 liter of liquor was seized. The petitioner is in custody since 2.1.2019. The recovery was made from the joint house and not from exclusive possession of the petitioner. Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand)

Patna High Court Cr.Misc. No.8851 of 2019(2) dt.14-02-2019 2/2 with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Special Case No. 110 of 2019 arising out of Khajekalan P.S. Case No. 1 of 2019.
