2. The petitioner seeks bail, who is in custody since 24.09.2025 in connection with Ghosi P.S. Case No. 512 of 2025, FIR dated 24.09.2025 registered for the offence under Section 103, 61(2) of the Bharatiya Nyay Sanhita, 2023.

3. According to the prosecution case, the informant alleged that the petitioner along with other co-accused persons killed her husband under conspiracy.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent and he has falsely been made implicated in this case merely on the basis of suspicion. Petitioner is not named in the FIR and and except suspicion, no other cogent material has come during

Patna High Court CR. MISC. No.12250 of 2026(3) dt.30-04-2026 2/2 investigation which suggest the involvement of the petitioner in the present occurrence and the petitioner is rotting in judicial custody since 24.09.2025.

5. Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that from bare perusal of the paragraph no.9 of the case diary, it suggests that some of the villagers have stated that the petitioner had assaulted and killed the husband of the informant by means of spade, and the same was also supported by the medical evidence.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Ghosi P.S. Case No. 512 of 2025, pending in the Court of C.J.M., Jehanabad.

7. Prayer is refused.
