The petitioner seeks bail in a case registered under Sections 364(A), 120(B)/34 of the Indian Penal Code. Allegation is that the daughter of the informant was kidnapped by unknown miscreants for ransom.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.5.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional statement of the coaccused. The petitioner has falsely been implicated in the present case. The victim has been recovered. Her statement has

Patna High Court CR. MISC. No.8279 of 2019(3) dt.02-05-2019 2/2 been recorded under Section 161 of Cr.P.C. The victim has not named the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Purnea in connection with S.T. No.447 of 2018 arising out of Sadar P.S. case No.196 of 2018.
