2. The petitioner seeks bail in connection with Bahadurpur P.S. Case No. 422 of 2024 dated 22.10.2024 instituted for the offence punishable under Sections 117(2), 109, 61(2) of Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that on the alleged date of occurrence, when the informant reached at Shekhar Line Hotel, Taralahi on his motorcycle bearing Registration No. BR06BV2343, a vehicle bearing Registration No. BR07GB5392 which was being driven by the petitioner, deliberately hit the informant which caused damage to the bike of the informant. The petitioner again attempted to hit the informant but the informant managed to escape away. It is alleged that one Md.
Patna High Court CR. MISC. No.9258 of 2025(3) dt.14-05-2025 2/3 Dulare gave Rs. 75,000/- to the petitioner to kill the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner further submits that the petitioner is the driver of Pick-Up van bearing Registration No. BR07GB5392. The petitioner is a professional driver having valid commercial driving license. True fact is that motorcycle of the informant got damaged while saving an animal on road. Learned counsel for the petitioner submits that alleged occurrence took place at about 7 am while the F.I.R. has been lodged at about 6.30 pm without any plausible explanation for the same. Learned counsel for the petitioner further submits that there is no motive of the petitioner to kill the informant. Lastly, it has been submitted that the petitioner is in custody since 23.10.2024 having one criminal case against him. Charge-sheet has been submitted in the case.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
