The petitioner seeks regular bail in connection with Khagaria Excise Case No. 139C3/2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 6 litres of illicit liquor from the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and though he is accused in six other cases but he is on bail in all the cases. Lastly, it is submitted that the petitioner is languishing in custody since 15.12.2018.

No.7377 of 2019(2) dt.11-02-2019 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-I/C Special Judge, Excise Act, Begusarai in connection with Khagaria Excise Case No. 139C3/ 2018.

It is further directed that since the petitioner is accused in similar type of cases from an earlier point of time, the present privilege of bail shall stand cancelled automatically, in case he is implicated in similar type of offence, henceforth. (Mohit Kumar Shah, J) S.Sb/- U T
