The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363, 365, 366A, 342/34 of the Indian Penal Code.

Allegation against the petitioners is that they kidnapped the minor daughter of the informant and kept her in their house for three days.

It is submitted that specific allegation of kidnapping and outraging the modesty of the daughter of informant is against Arvind Mahto. Petitioner no. 1 is mother and petitioner no. 2 is wife of co-accused Arvind Mahto and they have been

Patna High Court CR. MISC. No.9775 of 2023(2) dt.12-05-2023 2/2 made accused in this case simply because they are relatives of co-accused Arvind Mahto. Petitioners are ladies and they claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Judge, POCSO Act, Sitamarhi in connection with Runnisaidpur P.S. Case No. 189 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
