The Court comes to a considered opinion that no case of proceeding further in the contempt jurisdiction is made out. The stand of the counsel representing the University seems to be correct that restoration of the petitioner on the post of the Principal falls within the jurisdiction and the domain of the Managing Committee of the college in question.
The enquiry committee has already made recommendations in favour of the petitioner but any direction by the University will be uncalled for keeping in mind the power and the jurisdiction which is vested in the Vice-Chancellor and the decision
Patna High Court MJC No.2536 of 2016 dt.31-08-2016 2 / 2 making power vested in the Managing Committee of the affiliated college. Such a decision may be taken within a period of six weeks of the date of production of a copy of this order. The contempt application stands disposed of.
