1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 315 of 2022 dated 24.03.2022 registered for the offences punishable under sections 363 and 366A of the Indian Penal Code and later on, section 4 of POCSO Act was added.
3. Mr. Gopal Kumar Jha, learned counsel appearing for the petitioner submits that the petitioner is 21 years old person who has been languishing in jail since 28.11.2023 and the so-called victim has been recovered and she has also recorded her statement under section 164 of Cr.P.C. in which she did not make any allegation against the petitioner and the facts revealed by her before the Judicial Magistrate are completely against the prosecution's story. Patna High Court CR. MISC. No.11936 of 2024(3) dt.19-04-2024 2/2 further submits that the investigation has been completed against the petitioner.
4. Mr. Yogendra Kumar Singh, learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the above submissions, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Forbesganj P.S.
