2. The petitioner apprehends arrest in connection with Sadar P.S. Case No. 133 of 2020 dated 06.03.2020, instituted for the offence punishable under Sections 419 and 420 of the Indian Penal Code and Section 10 of Bihar Examination Act.

3. The prosecution case, in short, is that on 06.03.2020 in the second sitting of examination conducted by the Staff Selection Commission one candidate, namely, Ajit Kumar was found suspicious and on being inquired, he confessed that he is appearing in the exam in place of one Sujeet Kumar (petitioner).

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that only on the disclosure made by

Patna High Court CR. MISC. No.10571 of 2025(2) dt.28-03-2025 2/2 apprehended person Ajit Kumar, the petitioner has been made accused in this case. It is alleged that the admit card of the petitioner was found with the apprehended co-accused Ajit Kumar. It is also submitted that the said Ajit Kumar was trying to appear in place of Sujeet Kumar (petitioner). Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Sadar P.S. Case No. 133 of 2020, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-9th, Muzaffarpur (East), subject to condition as laid down under Section 438(2) of the Cr.P.C..
