JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Suresh Prasad Singh learned A.P.P. for the State. The petitioner seeks bail in connection with Madhubani P.S. Case No. 174 of 2021 instituted for the offences under Sections 272 and 273 and Sections 30(a), 32 and 41(i) of the Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 13.01.2022, charge-sheet has been submitted in the case and has antecedent of one case and allegation is of recovery of 190.800 liters of liquor from the house of co-accused Muntun Rai.
Learned counsel for the petitioner submits that petitioner was not arrested from the spot and the liquor was recovered from the house of Co-accused Muntun Rai and not
Patna High Court CR. MISC. No.7954 of 2022(2) dt.09-03-2022 2/2 from the house of petitioner and the name of the petitioner was disclosed by the local chowkidar who was on an inimical terms with the petitioner.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 13.01.2022 is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court No. 2, East Champaran, Motihari in connection with Madhuban P.S.
