JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was earlier granted privilege of anticipatory bail by a co-ordinate Bench of this Court with condition that he shall appear before the court below in person for the period of two years or till disposal of the case and in case of failure to appear before the court below on two consecutive dates, the bail granted to the petitioner shall be deemed to be cancelled. Petitioner made default in appearing for three consecutive dates resulting cancellation of his bail. Petitioner is in jail custody since 21.07.2015 for the above stated fault.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.54803 of 2015 (2) dt.10-12-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Sakari P.S. Case No. 140 of 2012.
