JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Marhowrah P.S. Case No. 384 of 2018, disclosing offences under Sections 366A, 506 of the Indian Penal Code.

Allegation against the petitioners and other other accused persons is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioners is that the statement of girl has been recorded, though she has stated her age about 14 years, but she has also stated that she has married with Mahesh Mahto with her own sweet will. Further submission is that the petitioners are co-villagers and have falsely been implicated in this case and they have no criminal

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 8th Saran at Chapra, in connection with Marhowrah P.S. Case No. 384 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
