JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-09-2022 The present writ petition has been filed seeking the following reliefs:- "1. That this is an application for issuance of writ, order or direction, particularly in the nature of Mandamus, directing the respondent authorities to remove the encroachment from the Gairmajarua Aam land pertaining to Khata No. 148, Plot No. 544, Area 0.60 acre sitaued in village-Lakshmipur under Gram Panchayat Raj-Belwa, Thana No. 105, Anchal

Patna High Court CWJC No.5946 of 2021(2) dt.09-09-2022 2/2 & P.S. Adapur, District-East Champaran used for the purpose of Government Pucca Sadak, which has been illegally encroached by the espondnet no. 5 to 11 making obstruction in going to the agriculture land of the petitioner."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Adapur, District-East Champaran for redressal of his aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Adapur, District-East Champaran by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
