2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a), 32(3), 41(1), 41(2) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, altogether 60 litres country made liquor has been recovered from two seized motorcycles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. No incriminating material has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion. Petitioner is not the owner of seized motorcycle. Petitioner has got one criminal antecedent of similar nature.

5. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.8319 of 2025(2) dt.06-03-2025 2/2 of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-II, Aurangabad in connection with Excise P. S. Case No. 1231 of 2024, subject to condition as laid down under Section 482 of B.N.S.S.
