The present writ petition has been filed seeking the following relief:- "That this is an application for issuance of an appropriate writ order or direction commanding the respondents to appoint the petitioner on the posts of constable/GD in C.R.P.F. as the petitioner had been successful in all the tests taken against Advt. published by Staff Selection Commission for C.P.O. for including C.R.P.F., C.I.S.F. etc. in 2011 as not

Patna High Court CWJC No.18761 of 2014 dt.02-08-2023 2/3 doing so will be highly illegal, arbitrary, malafidy and discriminatory or for any other order or orders which this Hon'ble Court may deem fit and proper under the circumstances of the case."

The learned counsel for the respondent-CRPF has submitted, by referring to paragraph no.5 of the counter affidavit filed in the present case, that though the petitioner was offered appointment and was requested to report for joining by 26.07.2014, along with relevant documents, the petitioner did not appear, and thereafter, several further opportunities were granted to him, but still the petitioner failed to submit his joining, and instead he submitted an application, belatedly to extend the joining time, on 20.08.2014, after expiry of the stipulated extended time granted to him for submitting his joining, hence his request was rejected, inasmuch as there is no provision with regard to extension in case where extension has already been granted earlier, for the purposes of submitting joining. 3.

The learned counsel for the petitioner has not disputed the aforesaid facts.

Having regard to the facts and circumstances of the case, this Court finds that the petitioner had defaulted by failing to submit his joining, not only once but thrice, hence, now at

Patna High Court CWJC No.18761 of 2014 dt.02-08-2023 3/3 this juncture, no relief can be granted to the petitioner herein. Thus the present writ petition stands dismissed being devoid of any merit.
