JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-07-2019 It appears that the petitioner has moved this Court seeking quashing of the selection of respondent no. 7 for grant of PDS Shop license which according to the petitioner has been wrongly granted de hors to the claim of the petitioner. It is submitted that the petitioner belongs to scheduled caste and was eligible to participate in the process for grant of the fair price shop license. He has raised his grievance vide Annexure '2' to the writ application before the District Magistrate, Nalanda at Biharsharif (Respondent No. 2). In his representation, he has alleged that the selected candidate Shibam Kumar is unmarried,

Learned counsel for the State submits that since the petitioner has represented his case before the District Magistrate, Nalanda at Biharsharif (Respondent No. 2), the District Magistrate may be directed to look into the same and take an appropriate decision thereon.

Having heard the parties and on perusal of the records, this Court is of the considered opinion that in the nature of the complaint made by the petitioner, the District Magistrate, Nalanda at Biharsharif shall look into the same, examine the matter and take an appropriate decision thereon after hearing all concerned within a period of 90 days from the date of receipt/production of a copy of this order.
