The present application has been filed for modification of the order dated 04.12.2018 passed in Cr. Misc. No. 72322 of 2018 by which the present petitioner along with others were granted bail in connection with Trial No. 3909 of 2017 arising out of Complaint Case No. 580C/2017 to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran and the petitioners were directed to surrender in the Court below within a period of six weeks and furnish bail bonds. Learned counsel for the petitioner submits that inadvertently due to typographical error in the cause title of
Patna High Court Cr.Misc. No.6945 of 2019(2) dt.15-02-2019 2/2 petition of Cr Misc. No. 72322 of 2018, the father's name of the petitioner no. 3 has been typed as "Hameed Meer" in place of "Habib Meer" and the same appeared in the order dated 04.12.2018 passed in Cr. Misc. No. 72322 of 2018. Considering the submissions made on behalf of the learned counsel for the petitioner and in view of the statement made in paragraph no. 3 of the present application, let in the cause title of order dated 04.12.2018 passed in Cr. Misc. No. 72322 of 2018, the father's name of the petitioner no. 3 be read as "Habib Meer" in place of "Hameed Meer". The period of surrender of petitioner no. 3 in the Court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.
The order dated 04.12.2018 passed in Cr. Misc. No. 72322 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, allowed. (Sudhir Singh, J) Pankaj/- U T
