JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned Special A.P.P. for the State.

This is an application for grant of regular bail on behalf of the petitioner who is an accused in Piro (Hasan Bazar) PS Case No. 234 of 2014 for the alleged offence under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code and under Sections 3(1)(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

From the first information report it appears that out of petty dispute between the parties, the occurrence took place. Keeping in view the nature of allegation and the fact that the petitioner has remained in custody since 21.7.2015, this application is allowed. Let the petitioner above-named be released on furnishing bail bond of Rs.10,000/- (ten thousand)

Patna High Court Cr.Misc. No.45492 of 2015 (2) dt.05-10-2015 2/2 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Piro (Hasan Bazar) PS Case No. 234 of 2014. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
