JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 22-06-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 419 of the Indian Penal Code and sections 66, 66(C), 66(D) of the Information Technology Act.

The allegation against the petitioner is to create a fake WhatsApp account of SIM Card Bearing Mobile No. 7099495553 and the said fake account has been created in the name of the then Superintendent of Police in which his

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. From perusal of the seizure list, nothing has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the alleged SIM Card bearing No. 7099495553 IMEI No. 865115056386210 does not belong to the petitioner. The petitioner is also accused in one more case, as stated in para 3 of the bail petition and there is nothing against the petitioner except his confessional statement. Charge-sheet has already been submitted in this case. The petitioner is in custody since 14.11.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail after framing of charge on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad. in connection with Aurangabad Town P.S. Case No. 420 of 2021 with a condition that the petitioner is directed to remain physically present before the learned Court below on each and
