Petitioner apprehends arrest in a case registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code.

As per prosecution case, this petitioner along with other accused persons kidnapped the daughter of the informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to personal enmity. It is next submitted that victim in her statement recorded under Section 164 of Cr.P.C. has not whispered any single word against the petitioner about commission of her alleged kidnapping.

Considering the statement of the victim recorded

Patna High Court CR. MISC. No.8191 of 2023(2) dt.12-05-2023 2/2 under Section 164 of Cr.P.C., let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzaffarpur in connection with Hathauri P. S. Case No. 219 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
