JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-02-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with S. Tr. No. 183 of 2013 arising out of Shankarpur P.S. Case No. 16 of 2013 registered under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected on merit vide order dated 11.03.2014 passed in Cr. Misc. No. 35929 of 2013 by this Court with observation to expedite the trial of the petitioner but up till now after framing of the charge only three witnesses have been examined by the prosecution.

Having considered the facts and circumstances

Patna High Court Cr.Misc. No.49250 of 2014 (2) dt.11-02-2015 of the case and direct allegation against the petitioner to cause arrow injury at the chest of the deceased, I find no ground to reconsider the prayer for bail of the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to conclude the trial of the petitioner within one year by taking all effective steps.
