The petitioner has prayed for bail in a case registered for the offence punishable under sections 414, 467, 468/34 of the Indian Penal Code.

It is a case of attempt of theft of motorcycle by the petitioner, who was arrested on spot and on search T shape master key and screen touch mobile were recovered from his conscious possession.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has not get any wrongful gain. While he was going towards road, villagers intercepted him and some altercation took place and they handed over him to the police and police implicated

Patna High Court CR. MISC. No.12420 of 2023(2) dt.28-04-2023 2/2 him in the present case. He has got no criminal antecedent. Petitioner is languishing in judicial custody since 24.11.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Muzaffarur in connection with Maniyari P.S. Case No. 395 of 2022.
