ANJANA PRAKASH ORAL ORDER 8/ 21-01-2015 The report of Trial Court is that the case could not proceed on account of absence of Case Diary.

The Case Diary appears to have been sent by the Superintendent of Police, Gaya, to this Court. Let the Case Diary be remitted to the Court concerned immediately.

The Trial Court is directed to be more careful in future and ensure that the records are complete before Charges are framed because if it is not done, witnesses are unnecessarily harassed on account of procedural lapses committed by the Court. The report of Sr. Superintendent of Police, Gaya, is that effective steps have been taken for examination of the witnesses.

Considering such aspect, I am not inclined to review

Patna High Court Cr.Misc. No.9316 of 2014 (8) dt.21-01-2015 2/2 the earlier order refusing bail to the Petitioner. Prayer of the Petitioner for bail in Fatehpur P.S. Case No.12 of 2011 pending before Ad hoc Additional Sessions Judge, III, Gaya, is once again rejected.
