JUSTICE RAKESH KUMAR ORAL ORDER 05-04-2019 Heard Sri Ashok Kumar Jha, learned counsel for the petitioners and learned Addl. Public Prosecutor. Seven petitioners, apprehending their arrest in Riga P.S. Case No. 309 of 2018 registered for offence under Sections 147, 148, 149, 447, 341, 323, 436, 427, 337, 338, 504, 506, 153, 153A, 295, 295A, 120B of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender. It was submitted by learned counsel for the petitioners that while petitioners were moving with the idol of 'Ma Durga',
Patna High Court CR. MISC. No.8138 of 2019(3) dt.05-04-2019 2/2 dispute arose in between two communities. Thereafter, a case was instituted by the administration side against number of accused persons, however the present case was lodged by the informant, who is not a public servant.
Earlier, case diary was called for, which has been received and kept on record. On examining the material on record and accusation, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid seven petitioners, namely, 1. Raja Sah, 2. Hari Sah, 3. Ram Janki Sah,
4. Ravi Sah, 5. Mukesh Sah, 6. Rakesh Sah and 7. Kumar Abhishek @ Sanjiv Kumar @ Sanjiv Prasad be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 309 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
