The petitioner seeks bail in connection with Case No. C1-411 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise (Amendment) Act, 2016. It is alleged in the written report that a Toyota vehicle was intercepted by the police party on which petitioner along with another co-accused Rajiv Mishra were found sitting. It is further alleged that Rajiv Mishra was driving the aforesaid vehicle. The police made search and recovered total 74.250 litres of foreign liquor from the aforesaid vehicle. Learned counsel for petitioner submits that petitioner was merely sitting on the aforesaid vehicle as passenger.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge (Excise Act), Purnea in connection with Case No. C1-411 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
