JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner happens to be the husband of the deceased but there is no allegation of illegal demand of dowry rather it is stated that the petitioner had established illicit relation with the wife of his younger brother which caused annoyance to the deceased. Moreover, it would appear from perusal of the first information report itself that the deceased consumed poison and after that she was taken to hospital by the family members of the petitioner and they tried their best to save the life of the deceased but they could not succeed in their attempt.

Considering the aforesaid facts and circumstances as well as the submissions of the parties, let the above named

Patna High Court Cr.Misc. No.45879 of 2015 (2) dt.30-09-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kahalgaon P.S. Case No. 229 of 2015 to the satisfaction of Md. Anwar Shamim, Judicial Magistrate, 1st Class, Bhagalpur.
