The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegations in the FIR, on a raid being conducted a total of 1166.4 litres of IMFL was recovered from a Tata 407 vehicle and five accused persons including the petitioner were taken into custody.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. No incriminating article has been recovered from his possession or from his vehicle of which he is a professional
Patna High Court CR. MISC. No.19009 of 2021(2) dt.01-09-2021 2/2 driver. He is in custody since 24.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, specially the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Shahpur Patori P.S. Case no. 443 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge - cum - Special Judge, Excise, Samastipur. (Partha Sarthy, J) Spd/- U T
