JUSTICE AKHILESH CHANDRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State, who is armed with carbon/xerox copy of the case diary.

The petitioner, who is languishing in custody, seeks bail in a case registered under Sections 302 of the Indian Penal Code and 27 of the Arms Act. In this case, instituted against unknown, petitioner's name appears emerging during investigation on some secret information. Submission is of false implication only because of his alleged involvement in four more cases, such as:- (i) Chanpatiya P.S. Case No. 260 of 2012, (ii) Lauriya P.S. Case No. 84 of 2012, (iii) Bettiah Town P.S. Case No. 399 of 2013 and (iv) Gopalpur P.S. Case No. 04 of 2014, wherein, he is on bail. Further, neither Test Identification Parade is conducted nor anything incriminating article, connecting his (petitioner) connection with the crime, has been recovered.

If it is so, having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on

Patna High Court Cr.Misc. No.42720 of 2014 (3) dt.21-01-2015 2/2 furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah (West Champaran), in connection with Chanpatiya P.S. Case No. 293 of 2013, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
