The application as against petitioner no.1, Pintu Kumar is, accordingly, dismissed as withdrawn. Heard learned counsel for petitioner no.2 and learned A.P.P. for the State.

Petitioner no.2, Vijay Turi @ Vijay Ram apprehends his arrest in Civil Line P.S. Case No.458 of 2019 registered under Sections 147, 148, 149, 323, 341, 504, 506, 353, 379,

Patna High Court CR. MISC. No.6405 of 2020(5) dt.18-11-2021 2/2 307, 332 and 333 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case. It is submitted that the petitioner has not been arrested on the spot and nothing incriminating materials have been recovered from his possession. The petitioner has got no criminal antecedent.

Learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail by contending that the petitioner and other accused persons are alleged to have assaulted the police persons, who were on duty, due to which the police persons received serious injuries.

Having considered the facts aforesaid, I am not inclined to enlarge petitioner no.2, Vijay Turi @ Vijay Ram on anticipatory bail. Accordingly, the same is rejected. (Arvind Srivastava, J) Harish/- U T
