JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-10-2015 Heard learned senior counsel, appearing on behalf of the petitioner and learned Assistant Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Jalley P.S. Case No.130 of 2012, disclosing offences under Sections 409, 420, 466, 467, 468 and 120B of the Indian Penal Code.
The petitioner, at the relevant point of time,
Patna High Court Cr.Misc. No.46610 of 2015 (2) dt.15-10-2015 2/3 during the financial year 2008-2009 was working as Panchayat Secretary of Ghanshyampur Panchayat, in Darbhanga district. On the allegation of irregularities committed in extension of the benefits under Indira Awas Yojna, he has been made accused in a case instituted in the year 2012.
Mr. Chittranjan Sinha, learned senior counsel, appearing on behalf of the petitioner, contends that the petitioner had no role to play in extending the benefit of the Indira Awas Scheme to beneficiaries nor he had any role to play in preparation of B.P.L. list. He has further submitted that the petitioner is in custody since 17.08.2015 and he, being a government servant, is not likely to flee away from the course of justice. In view of the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Jalley P.S. Case No.130 of 2012.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the
Patna High Court Cr.Misc. No.46610 of 2015 (2) dt.15-10-2015 3/3 event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
