The petitioner is languishing in custody since 01.04.2014 in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 14 years when the court assessed as 17 years where she stated that one boy took her on the pretext of illness of her mother to hospital and from there she was taken by that boy to his
Patna High Court Cr.Misc. No.42904 of 2014 (04) dt.04-03-2015 2/2 house where she was confined and from where she phoned her mother. Thereafter she was rescued but the victim has neither named this petitioner nor alleged any misbehaviour. The learned APP after going through the case diary has not controverted this contention of learned counsel for the petitioner that the victim refused to get medically examined. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur in connection with Rupaspur P.S.
