JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is not named in the FIR and it appears that the name of the petitioner came in this case in the course of investigation and after that charge-sheet was submitted showing him absconder. The petitioner was arrested in Kasma P.S. Case No. 50/2015 and after that he was remanded in the present case.

The contention on behalf of the petitioner is that the petitioner was not aware about the institution of the present case and, as a matter of fact, the police falsely implicated him and moreover, the petitioner has not been put on Test Identification Parade. It is further pointed out on behalf of the petitioner that

Patna High Court Cr.Misc. No.45850 of 2015 (2) dt.30-09-2015 2/2 having more or less similar allegations several co-accused are enjoying the privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Goh P.S. Case No.115 of 1997, corresponding to S.Tr. No. 231A of 1999/ 29 of 2012 to the satisfaction of the Additional Sessions Judge-1st, Aurangabad.
