Case No.239/19, registered under Sections 279, 337, 304(A) of the Indian Penal Code and later on Section 30(a) of Bihar wine Prohibition and Excise Act-2016 was added.

The driver of the vehicle was apprehended on the spot while the petitioner tried to flee away seeing police personals. There is recovery of 234 liters liquor from the vehicle.

Submission of learned counsel for the petitioner is that nothing incriminating article or liquor has been recovered from the physical possession of the petitioner. Petitioner is in custody since 28.12.2019 without any fault on his part, having no criminal antecedent and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Amas P.S. Case No.239/19, subject to condition that petitioner will cooperate in the investigation and appear before the police as and when required.
