JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Both the above stated petitioners are languishing in jail custody since 18.02.2019 in connection with Kadwa P.S. Case No. 39 of 2019 registered for the offences punishable under Section 395 of the Indian Penal Code.

No.82267 of 2019(3) dt.17-03-2020 2/2 Petitioners are named in the first information report and the informant claimed to have identified them while committing dacoity, furthermore, I find that both the petitioners do have criminal antecedent, therefore, I am not inclined to extend privilege of bail to the petitioners and, accordingly, their prayer for bail in connection with Kadwa P.S. Case No. 39 of 2019, pending in the court of learned Additional Sessions Judge-IV, Katihar stands rejected.
