JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gamahriya P.S. Case No. 123 of 2018, registered for the offences punishable under Sections 341, 323, 385, 379, 504 and 506/34 of the Indian Penal Code. Allegation against the petitioner is that he tried to lift the informant and when he raised alarm, he along with accused persons snatched Rs.15,000/- and a gold chain worth Rs.35,000/- and one camera worth Rs.5000/- were taken away. There is also allegation of demanding extortion and further petitioner is accused six other cases.
Submission of learned counsel for the petitioner is that he has falsely been implicated and he has lodged complaint cases against the informant before Lok Sikayat Niwaran Padadhikari and out of six cases, three have been lodged by the
Patna High Court CR. MISC. No.7266 of 2019(4) dt.01-05-2019 2/2 informant himself and other have been lodged by other accused against whom he made complaint and the supervising authority has not found the allegation of extortion true against him. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
With the above observation, this application is disposed of.
