The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he along with other accused persons killed the son of the informant. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against the petitioner. He submits that there is no eye witness to the said occurrence and only on the basis of suspicion, petitioner has been made accused in the present case. He further submits that petitioner has three criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 11.09.2019.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Parbatta P.S. Case No. 73 of 2013 pending before the court of the learned Additional Chief Judicial Magistrate-3rd, Khagaria. Accordingly, the application is dismissed. However, petitioner may renew his prayer for bail after framing of charge. (Anjani Kumar Sharan, J) devendra/- U T
