The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272, 273, 120B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 984. litres of foreign liquor has been recovered from the possession of co-accused Arun Sharma. He submits that coaccused Arun Sharma has been granted the anticipatory bail by this Court in Cr. Misc. No. 65561 of 2019 on 15.11.2019. He further submits that petitioner has no criminal antecedent as

Patna High Court CR. MISC. No.9116 of 2020(2) dt.28-02-2020 2/2 stated in para-3 of the bail petition.

However, petitioner is agreed to deposit Rs. 50,000/- in the Juvenile Justice Fund of the State Social Welfare Department.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II-cum-Special Judge Excise Act, Purnia in connection with Bhawanipur Police Station Case No. 142 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
