JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and as per prosecution case itself, the alleged occurrence took place on account of land dispute. There is omnibus allegation of assault against the petitioners and others. The post mortem report of the deceased reveals that altogether four injuries were found on his person and cause of death of the deceased was his head injury. Furthermore, it appears that only one injury on the head of the deceased was found and it is not clear as to who is author of the aforesaid injury.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released
