The petitioner seeks bail in a case registered for the offence under Sections 8(c), 20(b), 21(c) and 22(c) of the N.D.P.S. Act.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery of 4.4 Kg Ganja has been made from road and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 26.09.2019. Learned A.P.P. for the State has opposed the prayer
Patna High Court CR. MISC. No.8786 of 2020(2) dt.14-02-2020 2/2 for bail and submitted that 4.4 Kg Ganja has been recovered in front of the house of the petitioner. Moreover, the petitioner has also been an accused in a case registered for the offenses punishable under Section 37(b)(c) of the Bihar Prohibition and Excise Act.
Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
However, the petitioner may renew his prayer for bail after framing of charge.
