No one appears on behalf of the petitioner.

A dead body was recovered and accordingly a Fardbeyan was lodged by the Choukidar which gave rise to Bibhutipur P.S. Case No. 08/2013 instituted under section 302/34 IPC and section 27 of the Arms Act. The petitioner seeks bail in the said case.

The contention of the petitioner is that in course of investigation no evidence directly incriminating the petitioner in the alleged offence has been found. The petitioner is in custody since 21.01.2014. At the subsequent stage of investigation two persons were cited as accused(s) namely the petitioner and one Gore Lal Rai who has since been released on bail by this Court

Patna High Court Cr.Misc. No.44052 of 2014 (3) dt.04-02-2015 2 / 2 on 26.06.2014 passed in Cr. Misc. No. 7906 of 2014. Referring to the cases cited in paragraph 3 it has been submitted that the petitioner has been released in those cases and is facing the trial. In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ADJ, Rosera in connection with Bibhutipur P.S. Case No. 8/2013 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. During the subsistency of the present privilege if the petitioner is found involved in any criminal case of serious nature the same shall entail cancellation of his bond bonds.
