The petitioner is in custody since 06.08.2017 in connection with S.T. No. 352 of 2017 (Abadpur P.S. Case No. 125 of 2017) for the offence registered under Sections 376-D, 366, 342, 448, 506/34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 09.11.2017 passed in Cr. Misc. No. 51884 of 2017.
Learned counsel for the petitioner submits that in view of change circumstances that one of the similarly situated
Patna High Court Cr.Misc. No.9721 of 2019(2) dt.22-02-2019 2/3 co-accused persons, whose prayer for bail has also been rejected by this Court, has since been extended the privilege of bail vide order dated 04.01.2019 passed in Cr. Misc. No. 26939 of 2018. As such, the petitioner may also be extended the same benefit. Considering the aforesaid facts and circumstances of the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Katihar, District Katihar in connection with S.T. No. 352 of 2017 (Abadpur P.S. Case No. 125 of 2017), subject to the following conditions:-
1. One of the bailors will be his own blood relative, preferably, father, mother, son, brother, sister and/or his wife.
2. The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
3. The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
4. The petitioner shall co-operate with the investigation, if not already concluded, and make himself
